Terms of Service: Memory Canvas Co

Welcome to Memory Canvas Co (memorycanvasco.com.au). By placing an order or otherwise using this site, you agree to the terms below. Please read them before ordering.

1. About Us

Memory Canvas Co ("we", "us", "our") is a business based in Victoria, Australia. These terms, along with our Shipping Policy, Return & Refund Policy, and Privacy Policy, govern your use of this site and any purchase you make.

2. Eligibility

You must be at least 16 years old, or have a parent or guardian's permission, to place an order with us.

3. Products & Pricing

All prices are listed in Australian dollars (AUD) and include GST where applicable.
We try to keep product information, images, and pricing accurate, but errors can occur. If we find a pricing or listing error after you've ordered, we'll contact you before proceeding, and you can choose to continue at the correct price or cancel for a full refund.
Product photos (including size, colour, and finish examples) are representative. Because every kit is custom-made from your own photo, the finished product will vary based on the image you upload.

4. Your Uploaded Photos

When you upload a photo to create a custom kit, you confirm that:

you own the photo, or have the right and permission to use it (including permission from any identifiable people in it, and from a parent/guardian for any photo of a child); and
the photo doesn't infringe anyone else's copyright, privacy, or other rights.

You grant Memory Canvas Co a licence to use, reproduce, and print your uploaded photo solely for the purpose of creating and fulfilling your order. We don't use customer photos for marketing or any other purpose without asking you first.

We reserve the right to decline to print any image that appears to infringe someone else's rights, or that is offensive, unlawful, or otherwise inappropriate.

5. Order Acceptance & Cancellation

Placing an order is an offer to buy, which we may accept or decline (for example, if an item is mispriced, if we suspect fraud, or if we're unable to fulfil the order). If we decline or cancel an order, you'll receive a full refund.

6. Intellectual Property

Aside from the photos you upload, all content on this site, including text, logos, graphics, and design, belongs to Memory Canvas Co or its licensors and may not be copied or reused without permission.

7. Limitation of Liability

To the extent permitted by law, Memory Canvas Co isn't liable for any indirect or consequential loss arising from your use of this site or your order. Nothing in these terms limits any guarantee, right, or remedy you have under the Australian Consumer Law, which can't be excluded.
